These Terms of Service govern your purchase of products from Blackwater Nano (Blackwater LLC d/b/a Blackwater Nano, Elm Grove, WI).

 

1. Products and Intended Use

 

All materials sold through this store are intended for research, laboratory, and industrial use only. Products are not intended for food, drug, cosmetic, or household consumer applications. By placing an order, you confirm that you are purchasing for research or industrial purposes and that you have the training and facilities to handle the materials safely.

 

2. Safety Data Sheets

 

A Safety Data Sheet (SDS) is provided with every shipment. It is also available on request prior to purchase. It is the buyer's responsibility to review the SDS before handling any product and to ensure compliance with all applicable federal, state, and local regulations, including OSHA HazCom (29 CFR 1910.1200), at the buyer's facility.

 

3. Specifications and Certificates of Analysis

 

Product specifications listed on this website represent typical properties for the grade and are not guaranteed for any specific lot. A lot-specific Certificate of Analysis is available on request. Specifications are provided for informational purposes and do not constitute a warranty of fitness for any particular application. It is the buyer's responsibility to evaluate suitability for their intended use.

 

4. Limitation of Liability

 

Blackwater Nano provides materials as characterized chemical products. We make no warranty, express or implied, regarding fitness for a particular purpose or merchantability beyond what is stated on the product SDS and any lot-specific Certificate of Analysis. Our total liability for any claim arising from a product shall not exceed the purchase price of the product in question.

 

Blackwater Nano shall not be liable for any indirect, incidental, consequential, or special damages arising from the use or inability to use our products, including but not limited to damage to equipment, loss of data, or loss of revenue.

 

5. Regulatory Compliance

 

Buyers are responsible for ensuring their use of purchased materials complies with all applicable regulations, including but not limited to TSCA, OSHA, EPA, state, and local requirements. Blackwater Nano sells materials in compliance with applicable regulations but does not warrant that the buyer's specific application or use is compliant.

 

6. California Proposition 65

 

Certain products sold through this store contain chemicals known to the State of California to cause cancer or reproductive harm. Where applicable, Proposition 65 warnings are included on product labels. For more information, visit www.P65Warnings.ca.gov.

 

7. Age Requirement

 

You must be 18 years or older to purchase from this store.

 

8. Order Acceptance

 

All orders are subject to acceptance by Blackwater Nano. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or concerns about the intended use of the product.

 

9. Governing Law

 

These terms shall be governed by the laws of the State of Wisconsin. Any disputes arising from these terms or your use of this store shall be resolved in the courts of Waukesha County, Wisconsin.

 

10. Changes to Terms

 

We reserve the right to update these Terms of Service at any time. Changes are effective upon posting to this website.
